WASHINGTON D.C. – A federal judge ruled Wednesday that there is probable cause to hold the Trump administration in criminal contempt for failing to comply with a court order to return two deportation flights carrying migrants to El Salvador last month.

In a 48-page opinion, U.S. District Judge James Boasberg stated that the administration’s actions regarding the March 15 deportations showed a “willful disregard” for the court’s authority. The flights proceeded despite a bench ruling requiring their immediate return to the United States.

Boasberg said the court found sufficient grounds for criminal contempt based on what he described as “contumacious conduct.” He noted that further proceedings would be necessary to identify the individuals responsible for the noncompliance, including determining the specific acts or omissions that led to the violation.

The judge indicated that the Justice Department could prosecute the matter, or, if it declines, the court may appoint another attorney to pursue the case.

Boasberg gave the administration until April 23 to respond to his inquiries. Failure to do so, he said, would result in a formal referral for potential prosecution.
